Information that We Collect

The information that we learn from and about you helps us personalize and improve your experience and improve the rentals, products, and services that we (or a third-party with whom we have a relationship) provide you. Although most personal information is collected by third-party websites that are beyond our control, you may provide personal information to us (which we may collect and save) when you fill out a form on our website or communicate with us. That information may include, among other things, your name, address, telephone number, e-mail address, date of birth, social security number, home demographics, and pet ownership. In addition, we may collect and save information about IP addresses, browsers, and pages viewed. The information that we collect may fall into the following categories:

  • We do collect and share identifiers such as a real name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, account name, social security number, driver’s license number, passport number, or other similar identifiers
  • We do collect and share personal information described in California Civil Code Section 1798.80(e), which could include name, signature, social security number, physical characteristics or description, address, telephone number, passport number, driver’s license or state identification card number, insurance policy number, education, employment, employment history, bank account number, credit card number, debit card number, or any other financial information, medical information, or health insurance information

  • We do not collect biometric information, such as genetic, physiological, behavioral, and biological characteristics, or activity patterns used to extract a template or other identifier or identifying information such as imagery of the iris, retina, fingerprint, face, hand, palm, vein patterns, and voice recordings, from which an identifier template, such as a faceprint, a minutiae template, or a voiceprint, can be extracted, and keystroke patterns or rhythms, gait patterns or rhythms, and sleep, health, or exercise data that contain identifying information
  • We do collect and share internet or other electronic network activity information, including, but not limited to, browsing history, search history, and information regarding a consumer’s interaction with an internet website, application, or advertisement
  • We do collect and share and share geolocation data that, among other things, tracks physical location or movements
  • We do not collect sensory data, such as audio, electronic, visual, thermal, olfactory, or similar information

Part 99), which may include education records directly related to a student maintained by an educational institution or party acting on its behalf, such as grades, transcripts, class lists, student schedules, student identification codes, student financial information, or student disciplinary records
  • We do not collect inferences drawn from any of the information identified in this table to create a profile about a consumer reflecting the consumer’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes

We may collect the following specific information:

  • Contact Information such as current address, previous address, billing address, email address, telephone numbers, and emergency contact information and relationship.
  • Financial Information such as bank account number, routing number, credit or debit card number, and payment details.
  • Professional or Employment-Related Information such as your current employer, salary, and employment status.
  • Vehicle Information such as the type, make, model, year, color, and license plate number for you and any family members living with you.

  • Usage Data includes information about how you use our Services.
  • Marketing and Communications Information such as marketing campaign data, click-throughs, your preferences and consent in receiving marketing from us and our third parties, email and text communications, and your communication preferences.
  • References to personal information in this privacy polciy also refer to sensitive personal information (discussed below). Personal information does not include:
  • Publicly available information from government records
  • Deidentified or aggregated consumer information
  • Information excluded from the California Privacy Act’s scope, such as the following: health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA) or clinical trial data; personal information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FRCA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Drive's Privacy Protection Act of 1994.

 

Sensitive Personal Information

We collect Personal Information that is defined as “Sensitive Personal Information” under California and other state law, which may include (a) a consumer’s social security, driver’s license, state identification card, or passport number; (b) a consumer’s account log-in, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account; (c) a consumer’s precise geolocation; (d) a consumer’s racial or ethnic origin, religious or philosophical beliefs, or union membership; (e) the contents of a consumer’s mail, email and text messages, unless the business is the intended recipient of the communication; (f) a consumer’s genetic data; (g) the processing of biometric information for the purpose of uniquely identifying a consumer; (h) personal information collected and analyzed concerning a consumer’s health; or (i) personal information collected and analyzed concerning a consumer’s sex life or sexual orientation. We do not use or disclose Sensitive Personal Information for any business purposes other than as permitted by law, including providing goods and services, verifying your information, and/or as permitted by further regulations.

 

Aggregated Data

We may also collect, use, and share aggregated data such as statistical or demographic data for any purpose. Aggregated data may be derived from your Personal Information but is not considered Personal Information as this data does not directly or indirectly reveal your identity. However, if we combine or connect aggregated data with your Personal Information so that it can directly or indirectly identify you, we treat the combined data as Personal Information which will be used in accordance with this privacy notice.

 

How We Collect Personal Information

We may collect personal information in a variety of ways, including the following:

  • Information that you provide to us, such as information that you enter on our website or on a third-party website with whom we have a relationship or that you provide to us in another way.  We use the information that you provide for purposes such as responding to your requests and inquiries; customizing rental, product, or services offerings; improving Avenue5, and communicating with you.  For example, we collect and save information when you respond to a survey or marketing communication sent to you by a third-party vendor with whom we have a relationship.  This may include information provided when you:
  • Submit a Request for Information form or Guest Card
  • Submit a contact form
  • Call, email, or text us
  • Fill out a rental application
  • Sign a lease
  • Create an account on our Resident Portal
  • Request maintenance or repair services
  • Order or purchase other products and services
  • Attend our events where we collect information about you
  • Submit a review or testimonial
  • Automatic information, including information obtained when you interact with us.  For example, we use “cookies,” which are discussed in more detail below.
  • Mobile interactions, including obtaining information about your location and your mobile device.  This information may be used for a variety of purposes, including providing you with location-based services, advertising, search results, rentals, and other personalized content.  Most mobile devices allow you to turn off location services.
  • Information that we observe about, among other things, your preferences, rental history, or payment history.
  • Information from other sources.  The collection, use, and disclosure of personal information received from third parties is governed by the privacy policies on the website where the information was submitted by the user.

Using, Sharing, or Disclosing Information

We use personal information to provide you with information on the Avenue5 rentals, products, and services in which you have expressed an interest and on other rentals, products or services in which we believe you may have an interest. We use personal information for a variety of purposes, including to:

  • Provide you rentals, products, and services.
  • Improve our rentals, products, and services and the marketing of the same.
  • Improve the performance of, or content on, our website or to customize the content, layout, and services on the website.
  • Deliver information to you regarding rentals, products, or services.
  • Deliver communications to you regarding rentals, products, services, promotions, announcements, surveys, or other communications.
  • Engaging with prospective tenants.
  • Collecting and processing applications or contracts and communicating with you regarding your application or account.
  • Communicating with you and responding to questions you send to us.
  • Advertising and marketing our products and services to you.
  • Preventing and detecting fraud and otherwise complying with law.
  • Protecting and enforcing our legal rights.
  • Helping maintain the safety, security, and integrity of the services, databases, and other technology assets, and business.

  • To provide you with support and respond to your inquiries, including to investigate and address your concerns and monitor and improve our responses.

We generally do not disclose your personal information except in the following situations:

  • Third Parties with whom we have a relationship: We work closely with third-party vendors to provide you rentals, products, and services that are important to your experience with Avenue5.  To provide those rentals, products, and services, those third parties have access to personal information.  Those third parties are prohibited from using your personal information for other purposes.
  • Affiliates: We may share your personal information with an affiliate.
  • Business transfers or investments: As we continue to grow our business, we may sell, merge, or buy businesses or assets.  Customer information is typically one of the assets being transferred.  We also may share your personal information with a potential investor under an agreement which contains reasonable confidentiality requirements.
  • Protection of Avenue5 and others: We share account and other personal information when we believe sharing is appropriate to comply with the law; enforce or apply our terms of use and other terms and agreements; or protect the rights, property, or safety of Avenue5, our users, or others.  For example, Avenue5 may share information (a) with other companies and organizations for fraud protection and credit risk reduction; (b) to help Avenue5 defend against claims and/or exercise a legal right or remedy that Avenue5 may have; or (c) to respond to lawful requests by public authorities.
  • Legal Process: Subject to applicable law, we may disclose information about you (i) if we are required to do so by law, regulation or legal process, such as a subpoena; (ii) in response to requests by government entities, such as law enforcement authorities; (iii) when we believe disclosure is necessary or appropriate to prevent physical, financial or other harm, injury or loss; or (iv) in connection with an investigation of suspected or actual unlawful activity
  • Consent: Avenue5 may also share personal information with your consent.


The categories of personal information that have been identified above have been disclosed to service providers and other third parties for a business purpose in the past twelve months.

 

Length of Time Information Retained

The retention period for personal information and sensitive personal information varies depending on a variety of criteria including the following:

  • Property owner requirements that property information be turned over to them and deleted within a set period after termination of our property management engagement;
  • Property owner information retention policies;
  • The property management database which is used to collect, store, or share personal information;
  • Requirements of federal and state affordable compliance, brokerage, employment, and other laws regarding the retention of personal information and sensitive personal information;
  • Whether the consumer continues to be our employee or a resident of a property managed by us and when the consumer stopped being our employee or a resident of a property managed by us;
  • Whether the consumer continues to solicit goods, products, or services from us or a property managed by us; and
  • Whether the consumer owes a debt to a property managed by us.

Use of Cookies and Google Analytics

Cookies are information that we transfer to your device so that our systems recognize your device. Cookies make it easier for us to provide rentals, products, and services that are tailored to you. We use cookies to, among other things, understand and save user’s preferences for future visits, keep track of advertisements, assess the technical function of our website, and compile aggregate data about site traffic and site interactions to offer better site experiences.

We may use persistent tracking cookies on our website which are cookies that stay in your web browser between visits. These cookies can also be used to show us which sites you have visited before entering our website and which websites you may go to if you leave. Business Transitions

If Avenue5 goes through a business transition, such as a merger, acquisition, or sale, your personal information will likely be part of the assets transferred. By using the website and providing your personal information, you consent to this transfer.
 

Children under 13

We do not knowingly collect personal information from children under the age of 13. No part of our website is structured to attract anyone under 13. By using our website, you represent that you are not under 13 years of age. If you are a parent or guardian and you believe that your child under the age of 13 may have provided personal information through our website, please contact us by the means identified below.  To the extent that we receive personal information of a child under 13, we do not sell this information.

State Consumer Privacy Laws Notice

This notice supplements the Avenue5 Privacy Policy and it applies to “Consumers” (referred to as “you” or “your” in this Notice) as defined under state data privacy laws, including the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020.  As of the date Last Reviewed, the following states have enacted state data privacy laws, some of which have not been effective as of the date Last Reviewed: California, Colorado, Connecticut, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia.  Some of these state data privacy laws may characterize Avenue5 as a “service provider,” “processor,” or other designation.  To the extent that any of those state data privacy laws is applicable to Avenue5, you may have the rights set forth in this Notice.

Right to limit sensitive personal information processing

We only process Sensitive Personal Information for purposes permitted under applicable laws.

Right to Opt Out of Sale, Sharing, and Targeted Advertising

Our Site uses cookies and other online tracking technologies that may be considered a “sale” or “sharing” when processed for targeted advertising purposes as defined under applicable law.

  • The categories of sources for the personal information collected about you;
  • The business or commercial purpose for collecting, selling, or sharing that personal information;
  • The categories of third parties to whom personal information was disclosed, sold, or shared;
  • The specific pieces of personal information that were collected about you; and
  • The categories of personal information that were disclosed about you for a business purpose and the categories of persons to whom it was disclosed for a business purpose.

Right to delete

Residents of states with data privacy laws have the right to request that we delete any of personal information collected and retained, subject to certain exceptions. Once we receive your request and confirm your identity, we will review your request to see if an exception allowing us to retain the information applies. We may deny your deletion request if retaining the information is necessary for us or our service provider(s) and as permitted by applicable law. We will delete or deidentify personal information not subject to an exception from our records and will direct our service providers to take similar action.

Only you, a natural person, or an authorized agent may make a verifiable consumer request related to your Personal Information. You may make a verifiable consumer request on behalf of your minor child.

Your request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative; and
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. You do not need to create an account with us to submit a request. We will only use personal information provided in the request to verify the requestor’s identity or authority to make it.

Right to appeal

Residents of certain states may have the right to appeal our decision with respect to a request. To appeal a decision, please contact us through the ways listed above or any method outlined in the decision.

Authorized agents

You may use an authorized agent to make a request for you, subject to our verification of the agent, the agent’s authority, and your identity. If you are using an authorized agent to make a request, you or the agent must submit the following to the email address in the Contact Information section below:

  • A copy of a power of attorney provided by the consumer pursuant to applicable law; or
  • Proof of signed permission along with a copy of the agent’s ID and an email directly from the consumer to us confirming that they provided the agent permission to submit the request.
     

Response timing and format

We will acknowledge a verifiable consumer request within ten (10) days of receipt, where applicable law requires, and we will respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing.

Any disclosures we provide will only cover the 12-month period preceding our receipt of your request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your Personal Information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

 

Non-discrimination and no retaliation

We will not discriminate against you for exercising any of your consumer privacy rights. Unless permitted by the consumer privacy laws, we will not:

  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

However, we may offer you certain financial incentives permitted by California Privacy Act that can result in different prices, rates, or quality levels. Any California Privacy Act-permitted financial incentive we offer will reasonably relate to your personal information’s value and contain written terms that describe the program's material aspects. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time.

 

Other California Privacy Rights

California's “Shine the Light” law (Civil Code Section § 1798.83) permits users of our Website that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. Changes to Our Privacy Notice

Avenue5 reserves the right to amend this privacy notice at our discretion and at any time.
